Outrage, Condemnation of Fox Host’s Islamophobic Ilhan Omar Comments

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”

Fox News host and legal pundit Jeanine Pirro sparked controversy over the weekend when she made questionable comments regarding Representative Ilhan Omar (D-MN-5th). The following comments come from her Justice with Judge Jeanine show from Saturday evening.

“Think about this, she’s not getting this anti-Israel sentiment doctrine from the Democrat party, so if it’s not rooted in the party, where is she getting it from? Think about it. Omar wears a hijab, which according to the Quran 33:59 tells women to cover so they won’t get molested. Is her adherence to this Islamic doctrine indicative of her adherence to Sharia law? Which in itself is antithetical to the United States Constitution?”

The Issue With Pirro’s Statement

Aside from the assumption that all women who wear hijab are anti-Semitic by default, Jeanine Pirro uses sharia law as a way to say Rep. Omar is against the United States Constitution. While far from a sound argument the Islamic Supreme Council of America (ISCA) clarifies to whom the tenants of Sharia apply to:
Islamic civilization, since the time of Prophet Muhammad (s) until now, is firmly founded on the concept of ‘rule of law.’ For that reason, the law is published and known, and citizens and courts are expected to uphold it. In addition, Muslim citizens must adhere to Islamic law – Shariah. If a Muslim citizen commits a religious violation, he is judged according to Islamic law. A non-Muslim citizen is judged in religious issues by the laws of his own faith.
The organization goes on to detail the extremist perversion of the religious text that is a common facet of the radical Wahabi sect of Islam.
One of the main forms of extremism in religion is complete ignorance of the comprehensive nature of Islam. This is what makes an individual who has knowledge of parts but not the whole think he has entered the circle of scholars when the fact is he knows nothing but bits and pieces that he uses to deduce a verdict. Such a verdict will invariably be fraught with error.
In their ignorance of religion and in their pride, people are lead to hold tight to the literal meanings of the source texts without trying to understand the multiple meanings and the intent and purpose behind the revelation or a relevant action or saying of the Prophet (s). Today extremists are bringing back the school that was known as the school of literality (al-dhahiri). That school originally refused to take into consideration qiyas, analogy, or reasoning between different rules, or precedence in law.

A simple example: the Prophet (s) prohibited individuals from traveling to areas of non-Muslims or areas of unbelievers carrying the Holy Qur’ān.[57] If we look today however, we find that the Holy Qur’ān is on the shelf of the library of any country in the world, Muslim or not.

In the time of the Prophet (s), the concern was that the Holy Qur’ān time was written by hand in fragments of skins and parchment, etc. and there was fear that the words might be twisted and meanings altered. Today that problem no longer exists, as the Qur’ān has been gathered and formalized, so to travel with the Qur’ān is no longer an issue.

The extremist on the other hand, will declare that the letter of the saying must be obeyed, without taking into consideration the circumstances and reasons for this ruling.
Pirro’s statement spread misinformation and has been called Islamophobic in nature by many detractors over the past several days. Pirro’s claims are also in conflict with the ‘free exercise clause’ found in the First Amendment of the Constitution which reads, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”
Simply put, Muslims living in the United States are not in violation of the Constitution due to their religion.

CAIR Responds, Fox and Pirro Release Comments

“Such an open and un-American expression of religious bigotry should be rejected by any media outlet seeking even a modicum of credibility,” said Council on American-Islamic Relations (CAIR) National Executive Director Nihad Awad in a press release by CAIR to journalists. “Jeanine Pirro should be fired, and Fox News should apologize to its viewing audience.”
Awad would also call for advertisers to boycott the network. Fox News responded to widespread criticism in a brief statement released to the press.
We strongly condemn Jeanine Pirro’s comments about Rep. Ilhan Omar. They do not reflect those of the network and we have addressed the matter with her directly.
Pirro also responded to the situation backtracking from her original tone, “I’ve seen a lot of comments about my opening statement from Saturday night’s show and I did not call Rep. Omar un-American,” she began. “My intention was to ask a question and start a debate, but of course because one is Muslim does not mean you don’t support the Constitution.”
